LD 1028 This bill increases the cigarette tax from $2.00 to $3.50 per pack of 20 cigarettes and increases the tax on all other tobacco products including electronic cigarettes to 81% of the wholesale sales price, beginning November 1, 2019. The bill provides that, if the tax on cigarettes is increased on or after November 1, 2019, the tax on all other tobacco products will be adjusted by a rate that is equivalent to the percentage change in the tax rate for one cigarette. The bill provides ongoing funding, $11,100,000 per year, to the Department of Health and Human Services, Maine Center for Disease Control and Prevention for tobacco use prevention and cessation in order to align with the United States Department of Health and Human Services, Centers for Disease Control and Prevention recommendations. The bill also provides $1,000,000 in fiscal year 2019-20 and $750,000 thereafter for MaineCare members for tobacco use cessation medications and counseling. Finally, the bill provides $250,000 per year in ongoing funding to the Attorney General's office for increased tobacco enforcement activities. Amendment H-622 This amendment strikes the bill and instead increases the tax on tobacco products, other than cigarettes, to 43% of the wholesale sales price, beginning January 2, 2020, and includes electronic smoking devices and liquids used in electronic smoking devices in the definition of "tobacco products." The amendment provides that, if the tax on cigarettes is increased after January 2, 2020, the tax on smokeless tobacco and other tobacco products will be adjusted by a rate that is equivalent to the percentage change in the tax rate for one cigarette. The amendment provides ongoing funding of $5,100,000 in each year of the biennium to the Department of Health and Human Services, Maine Center for Disease Control and Prevention for tobacco use prevention and cessation in order to align with the United States Department of Health and Human Services, Centers for Disease Control and Prevention recommendations. The bill also provides $1,000,000 in fiscal year 2019-20 and $750,000 in fiscal year 2020-21 for tobacco use cessation medications and counseling for MaineCare members. Some of the services the new program may provide include assisting with filing complaints and appeals regarding decisions made by a group health plan, health insurance carrier or independent review organization and obtaining health insurance premium tax credits on behalf of consumers. The Superintendent of Insurance is required to contract with a nonprofit, independent health insurance consumer assistance entity that is not an insurer to operate the consumer assistance program, and funding is provided for that requirement. Amendment S-110 This amendment transfers the responsibility for contracting for the Health Insurance Consumer Assistance Program from the Bureau of Insurance to the Attorney General. This bill also establishes a moratorium on the issuance of any permit, certificate or other approval by the Public Utilities Commission or the Department of Environmental Protection for a high-impact electric transmission line until 90 days after the adjournment of the Second Regular Session of the 129th Legislature to allow time for the commission, in consultation with the Department of Environmental Protection, to adopt rules necessary to implement the requirements of the legislation.

The bill requires the Department of Agriculture, Conservation and Forestry, Bureau of Parks and Lands to submit a lease of public lands for commercial purposes to the joint standing committee of the Legislature having jurisdiction over public lands matters for approval, amendment or disapproval by the committee. The joint standing committee must submit its recommendation to the Legislature for approval. If the Legislature does not approve the lease, the bureau may not enter into the lease. The bill also requires the Director of the Bureau of Parks and Lands to examine all leases of public reserved lands entered into by the State since January 1, 2014 to determine whether those leases are in compliance with these requirements. The director is required to report the findings of this examination, including any recommendations for action on noncompliant leases, to the Joint Standing Committee on Agriculture, Conservation and Forestry no later than March 1, 2020. LD 2096 This bill provides that a health insurance carrier that provides coverage for prescription insulin drugs may not impose a cost-sharing requirement on the enrollee that results in out-of-pocket costs to the enrollee in excess of $100 per 30-day supply of insulin. Amendment H-772 This amendment replaces the bill. Part A provides that a health insurance carrier that provides coverage for prescription insulin drugs may not impose a cost-sharing requirement on an enrollee that results in out-of-pocket costs to the enrollee in excess of $35 per prescription for a 30-day supply of insulin. The requirements apply to all health insurance policies issued or renewed on or after January 1, 2021. Part B authorizes a pharmacist to dispense emergency refills of insulin and associated insulin-related supplies. The amendment requires that the insulin dispensed be in a quantity that is the lesser of a 30-day supply and the smallest available package. The amendment also requires the Maine Board of Pharmacy to adopt rules to establish adequate training requirements and protocols for dispensing insulin. LD 2097 This bill establishes requirements for the approval of construction of elective transmission lines when the party seeking approval from the Public Utilities Commission is a transmission and distribution utility. The bill defines "elective transmission line" as a transmission line that is not being constructed primarily for reliability purposes or to serve retail customers in the State. LD 2112 This bill prohibits the selling, leasing, renting, installing, use or entering into commerce of any product or equipment that uses or will use a substance that is a hydrofluorocarbon with high global warming potential intended for any air conditioning, refrigeration, foam or aerosol propellant end use as determined by the Department of Environmental Protection in rules. It directs the department to adopt rules to implement the prohibition and specifies the substances and end uses that are to be addressed in the rules. In adopting the initial rules, the department must regulate each substance and end use as specifically provided for in the bill and may not regulate any substance or end use not addressed in the bill. In the future, the department may adopt rules adding or removing substances from the list of prohibited substances or adding or removing end uses. |

This Part directs the Maine Municipal Bond Bank to transfer $20,000,000 during fiscal year 2019-20 from the Liquor Operation Revenue Fund to the unappropriated surplus of the General Fund. PART JThis Part directs the State Controller to transfer $17,431,338 during fiscal year 2019-20 from the General Fund unappropriated surplus to the Maine Budget Stabilization Fund established in the Maine Revised Statutes, Title 5, section 1532. PART KThis Part authorizes the Department of Agriculture, Conservation and Forestry, Bureau of Forestry to pay operating expenses from the Aerial Fire Suppression Fund. PART SThis Part implements criminal history record checks for certain individuals with access to federal tax information and other federally protected data at the Department of Administrative and Financial Services, Office of Information Technology. The criminal history record checks apply to all new applicants and current employees and contractors or subcontractors of the office to ensure compliance with federal laws and regulations governing access to federally protected data, including, but not limited to, the Internal Revenue Service's criminal history record check requirements for all employees and contractors with access to federal tax information and the Federal Bureau of Investigation's Criminal Justice Information Services Division. PART WThis Part authorizes the Department of Health and Human Services to transfer available balances of Personal Services appropriations and allocations in the Disproportionate Share - Dorothea Dix Psychiatric Center program, the Disproportionate Share - Riverview Psychiatric Center program, the Riverview Psychiatric Center program and the Dorothea Dix Psychiatric Center program after all salary, benefit and other obligations are met to the All Other line category. PART XThis Part updates references to the United States Internal Revenue Code of 1986 contained in the Maine Revised Statutes, Title 36 to refer to the United States Internal Revenue Code of 1986, as amended through December 31, 2019, for tax years beginning on or after January 1, 2019 and for any prior tax years as specifically provided by the United States Internal Revenue Code of 1986, as amended. It also provides that, for tax years beginning on or after January 1, 2020, the Maine standard deduction under the Maine income tax is equal to the federal standard deduction and is not limited by the federal Internal Revenue Code of 1986, Section 63. PART YThis Part clarifies that, with regard to each hospital in the State, the hospital’s fiscal year that ended during calendar year 2016 is intended to be the hospital’s taxable year for all state fiscal years beginning on or after July 1, 2019 for the purpose of taxes imposed by Title 36, section 2892. PART BBThis Part requires the Department of Health and Human Services to amend the Office of Elderly Services Policy Manual, 10-149 C.M.R. Chapter 5, Section 63 to increase the number of reimbursable medication passes per consumer per day from 3 to 6. PART CCThis Part transfers $2,036,206 to the Maine Commission on Indigent Legal Services; this transfer is in addition to a transfer of $16,526,403 made in July 2019. PART DDThis Part transfers funds from the Inland Fisheries and Wildlife Carrying Balances - General Fund account to the Enforcement Operations - Inland Fisheries and Wildlife program, General Fund account to fund a Personal Services shortfall in fiscal year 2019-20. PART EEThis Part reduces unemployment insurance trust fund contributions for employers by a percentage used to calculate the Unemployment Program Administrative Fund assessment except as described in the Maine Revised Statutes, Title 26, section 1221, subsection 4-A, paragraphs A and B pertaining to new employer rates and contribution rate category 20. PART FFThis Part establishes the Unemployment Program Administrative Fund for the purpose of operating the Maine unemployment insurance program, including both personnel and nonpersonnel costs, and for the costs of administering the fund. PART GGThis Part authorizes the use of unemployment insurance modernization funds under the American Recovery and Reinvestment Act of 2009 and Section 903(f) of the federal Social Security Act for the purposes of operating the State's unemployment compensation and public employment systems. This Part authorizes the carry-forward of any remaining balance of the amount appropriated in Public Law 2019, chapter 343 in the Office for Family Independence - District program, General Fund account within the Department of Health and Human Services for the purpose of upgrades to the public assistance web portal to be used for the same purposes in the next fiscal year. PART NNThis Part authorizes a transfer of a portion of the accumulated balance in the operating account of the Maine Governmental Facilities Authority to the State in fiscal year 2019-20. This balance has built up over the last 20 years from loan initiation fees, maintenance fees and related interest that exceed amounts needed to fund the actual costs of administering these loans and has been identified as a resource that could be transferred to the State.
